Maryland — MODPA
Md. Code, Com. Law § 14-4701 et seq.
- Effective October 1, 2025 — the law is already in force.
- Hard data-minimization rule that consent cannot waive.
- Sale of sensitive data is prohibited outright — not just opt-in.
- Opt-out preference signals (like Global Privacy Control) must be honored.
- Cure period runs through April 1, 2027 — enforcement discretion, not immunity.
Virginia — VCDPA
Va. Code § 59.1-575 et seq.
- In force since January 1, 2023.
- Rights to access, correct, delete, and opt out of sale/targeted ads.
- Right to appeal a denied request — unique among early state laws.
- Opt-in consent for selling data of consumers aged 13–16.
- 45-day response window for consumer rights requests.
